Dag Voorzitter, dag Kamer van Volksvertegenwoordigers

Allereerst, opnieuw, bedankt aan jullie allen voor het harde én noodzakelijk werk dat jullie verrichten om onze democratie en samenleving draaiende te houden. Echter, ondanks dat België een fantastisch land is waarin ik uit de diepste dalen van mijn leven ben geholpen door de fantastische hulpverlening, gefinancierd uit de sociale zekerheid (een politiek-rechtvaardige keuze), ben ik vandaag de dag teleurgesteld Belg en Europeaan te zijn...

Eén van de functies van een parlement is de norm stellen naar de samenleving toe. Zo vinden wij als samenleving het bijvoorbeeld belangrijk dat mensen in België menselijk kapitaal ontwikkelen, daarom subsidiëren onze gemeenschappen en gemeentes ook het onderwijs hevig. Of vinden wij diefstal onwenselijk als samenleving, daarom is dit onder artikel 461 van het Strafwetboek strafbaar gesteld.

Nu vinden wij het collectief uithongeren van een bevolking ook onwenselijk als samenleving. Toch doet de staat Israël het en dreigen veel Gazanen te sterven bij ontoereikende voeding. Eén van de vele rechtsnormen die de staat Israël hier schendt is zo bijvoorbeeld artikel 11 paragraaf 1 van het IVESCR, waarbij Staten het recht erkennen van iedereen voor een behoorlijke levensstandaard voor zichzelf en dienst gezin, waaronder toereikende voeding behoort. Door kinderen en baby's moedwillig te verhongeren, schendt de staat Israël ook gelijk artikel 12 van datzelfde verdrag, waarin het recht op gezondheid wordt gewaarborgd, zowel lichamelijk als geestelijk. Dit is maar één voorbeeld van de vele internationale rechtsnormen die Israël schendt. Zo schendt Israël ook artikel 6 van het BUPO-verdrag (internationaal verdrag inzake Burgerrechten en Politieke Rechten) omdat ze het recht op leven niet waarborgt van de Gazanen. Verder wordt artikel 7 van datzelfde verdrag geschonden, namelijk dat niemand onderworpen mag worden aan folteringen, noch aan wrede, onmenselijke of onterende behandeling of bestraffing. En ik kan zo doorgaan... Maar nu bereiken we de crux...

Het EU-Israël Associatieverdrag. Israël schendt daarbij allereerst artikel 2 in directe mate, en steekt het ook niet onder stoelen en banken. Artikel 2 van dat verdrag waarborgt dat alle partijen mensenrechten en democratische beginselen eerbiedigen, zowel in binnenlands als buitenlands bestuur. Mensenrechten zijn niet gewaarborgd gezien Israël collectieve bestraffingen uitvoert, honger gebruikt als wapen, civiele infrastructuur vernietigt. Ook worden in de geest van de wetgever nog andere artikels van dat verdrag geschonden. Deze laat ik buiten beschouwing in dit verzoekschrift.

Op basis van de schending van artikel 2 van het Associatieverdrag kan de EU echter op basis van artikel 79 paragraaf 2 van het verdrag het verdrag opschorten of beëindigen. Nu is er een onderzoek gestart of het verdrag geschonden is, maar de Gazanen kunnen niet meer wachten en er is bewijsmateriaal overal. Om maar de eerste op te noemen in mijn hoofd: Amnesty die concludeert dat er een genocide gaande is in Gaza, uitgevoerd door de staat Israël (geleid door Netanyahu). Daar wil ik nu kort op terugkomen om af te sluiten.

Genocide, dat is ook zo'n ding dat we onwenselijk vinden in onze samenleving, daarom hebben we daar ook rechtsnormen voor (buiten onze menselijke moraliteit, natuurlijk). In artikel 136bis van onze strafwetboek wordt genocide, in overeenstemming met het Verdrag van 9 december 1948 inzake de voorkoming en bestraffing van genocide, strafbaar gesteld. Genocidehandelingen zijn:

1. Het doden van leden van de groep;

2. Toebrengen van ernstig lichamelijk of geestelijk letsel aan de leden van de groep;

3. Opzettelijk aan de groep opleggen van levensvoorwaarden die de fysieke vernietiging tot gevolg hebben (zoals uithongering!!!);

4. Maatregelen opleggen om geboorten binnen de groep te voorkomen;

5. Gewelddadig overbrengen van kinderen naar een andere groep.

Met een groep zijnde een nationale, etnische, godsdienstige of rassengroep.

Nu was het voor de collectieve uithongering al duidelijk, maar voor wie nog twijfelde is het tijdens en na deze collectieve hongering ook duidelijk dat er een genocide plaatsvindt. De Gazanen kunnen niet wachten op een onderzoek. Er moet - NU - actie komen.

Hoe kunnen wij ons nog een waardegedreven Unie noemen, als we wegkijken van deze wantoestanden? Maar buiten deze morele vraagstuk, stelt België zichzelf strafbaar door ontoereikende maatregelen te nemen in haar buitenlands beleid, gezien artikel 8 van het Genocideverdrag onze overheid een positieve verplichting oplegt om maatregelen te nemen om een genocide te voorkomen... Maar ja, deze is de facto al aan het gebeuren. Wilt België, juridisch én moreel, aan de foute kant van de geschiedenis staan? Wilt de EU dat? Nogmaals: zijn wij een waardegedreven Unie? Dan moeten, zoals de tien universiteitsrectoren zeiden, er ook waardegedreven beslissingen genomen worden.

Zelf hoop ik dat jullie dit signaal van mij en vele anderen met mij, als gewone burger en gewone burgers, serieus nemen, want het recht op leven is er voor iedereen - niet alleen voor een specifieke groep mensen. Ik roep alle Kamerleden ook niet alleen op het juridisch recht, maar ook op het moreel recht. Hoe kunnen we als mensheid wegkijken, terwijl er tienduizenden mama's, papa's, kinderen, baby's ... allemaal sterven?

Schort de EU-Israël Associatieverdrag dan NU ook op. België kan dit niet alleen, maar pleit NU voor de DIRECTE opschorting van het EU-Israël Associatieverdrag.

Bij deze dan ook het einde van mijn betoog, als gewone burger. Ik bedank jullie allemaal nogmaals voor jullie harde werk voor onze democratie, om deze draaiende te houden en om normen te stellen naar de samenleving via wetgeving. Misschien is het tijd om - zeer dringend - een duidelijke norm te stellen naar de staat Israël. Zoals ik in het begin ook zei: de Belgische welvaartsstaat heeft mij persoonlijk door een zeer diep dal geholpen in mijn leven. En daar ben ik eeuwig dankbaar voor, net zoals vele en vele Belgen waarschijnlijk. Laten we nu samen, collectief als Belgen, de Gazanen door deze schrijnende mensonterende genocide helpen, zodat er hopelijk ooit een wederopbouw kan komen - of mensen gewoonweg in leven blijven, zodat ze die wederopbouw hopelijk ooit kunnen meemaken.

First of all, once again, thank you all for the hard and essential work you do to keep our democracy and society functioning.

However, although Belgium is a fantastic country — one in which I have been helped through the darkest valleys of my life thanks to excellent social services funded by social security (a politically and morally just choice) — today I find myself disillusioned to be a Belgian and a European citizen.

One of the key functions of a parliament is to set norms for society. For example, we collectively find it important that people in Belgium develop human capital — and that is why our communities and municipalities heavily subsidize education. Or we find theft to be socially undesirable — and that’s why it is criminalized under Article 461 of the Penal Code.

We also, as a society, deem the collective starvation of a population to be deeply unacceptable. And yet, the State of Israel is doing just that, and many Gazans are now at risk of dying from inadequate nutrition. One of the many legal norms being violated by Israel is Article 11(1) of the International Covenant on Economic, Social and Cultural Rights (ICESCR), which guarantees the right to an adequate standard of living, including adequate food. Beyond this moral question, Belgium risks legal liability for taking insufficient action in its foreign policy, since Article 8 of the Genocide Convention places a positive obligation on our government to take measures to prevent genocide. But this genocide is already happening. Does Belgium want to be on the wrong side of history — legally and morally? Does the EU? Once more: are we truly a values-based Union? Then, as the ten university rectors have said: values must be followed by value-based decisions.

I sincerely hope that you take this signal — from me and many other ordinary citizens — seriously. The right to life applies to everyone, not just to a particular group. I call on all Members of Parliament not only to uphold legal justice, but moral justice as well. How can we, as a humanity, look away while tens of thousands of mothers, fathers, children, and babies are dying?

Suspend the EU-Israel Association Agreement — NOW. Belgium cannot do it alone, but it can and must advocate now for the immediate suspension of this agreement.

With that, I conclude my appeal — as an ordinary citizen. Thank you once again for your hard work in maintaining our democracy and for setting societal norms through legislation. Perhaps it is time — urgently — to set a clear norm toward the State of Israel. As I said in the beginning: the Belgian welfare state helped me through one of the lowest points of my life. For that, I will be forever grateful — as surely many Belgians are. Let us now, together and collectively, help the people of Gaza survive this horrific and inhuman genocide, so that — hopefully — a process of rebuilding can begin one day. Or at the very least, so they stay alive long enough to see it happen.
